TERMS OF USE FOR THE PRESS AREA OF THE JAB ANSTOETZ GROUP
By downloading the images and videos posted in this press area, you agree to the following terms of use and commit to comply with them when using the downloaded images and videos .
Provided that the terms of use are observed, the images and videos made available may be downloaded and used free of charge:
- The JAB ANSTOETZ Group reserves the rights of use to the images and videos published in the press area.
- The option to download the images and videos published in the press area free of charge is subject to change and may be revoked by the JAB ANSTOETZ Group at any time.
The right of use granted to the user by the JAB ANSTOETZ Group by downloading the images and videos may be revoked by the JAB ANSTOETZ Group with immediate effect due to good cause (e.g. but not limited to failure to disclose the JAB ANSTOETZ Group as the copyright owner in accordance with section 3).
- The user is obligated to identify the JAB ANSTOETZ Group as the owner of the image and video rights when using the images and videos. The name "JAB ANSTOETZ Group" must either be mentioned or the logo of the member of the JAB ANSTOETZ Group to which the published picture or video belongs must be displayed (e.g. the logo of BW for pictures and videos from the Bielefelder Werkstätten area).
- Some of the images and videos provided show photo models, i.e. people. The use of such images and videos is only authorised for a period of 24 (twenty-four) months from the date of appearance of the images in the press area. The date of publication and the end of the period of use are indicated in the download area for the respective image or video.
The user undertakes to use such images and videos only within the authorised period. In case the user utilises the images and videos beyond the authorised period and claims are made against the JAB ANSTOETZ Group by third parties as a result, the user shall indenify the JAB ANSTOETZ Group against all claims made by such third parties.
The user shall also reimburse the JAB ANSTOETZ Group for any required expenses incurred by the JAB ANSTOETZ Group in defending itself against such third-party claims.
- The images and videos downloaded from the press area may not be used in any manner that is potentially damaging to the reputation and standing of the JAB ANSTOETZ Group. The JAB ANSTOETZ Group is responsible for determining when such damage has occurred.
Editing or altering the images and videos is permitted only to the extent that it is necessary for technical adjustments (e.g. cropping, resizing or format conversion). Changes to the content, in particular through the use of artificial intelligence or comparable technologies that alter, distort or generate new content, are not permitted. This also applies to the subsequent addition of audio content, in particular music, to videos.
- The transfer of images and videos downloaded from the press area to third parties is only authorised if the third party complies with these terms of use.
The user shall be liable to the JAB ANSTOETZ Group in case the third party does not comply with these terms of use. The user indemnifies the JAB ANSTOETZ Group against all claims of third parties arising from the unauthorised use of the images and videos by this third party employed by the user.
- The liability of the JAB ANSTOETZ Group, its legal representatives or vicarious agents with respect to claims for damages against the user arising from the images and videos published in the press area shall be limited to intent and gross negligence. The obligation to pay compensation in this case shall be limited to foreseeable damage typical for the contract.
The limitation of liability shall not apply to injury to life, body or health.
- The place of jurisdiction for disputes in connection with the use of the images and videos published in the press area shall be Bielefeld, Germany, if the user is a merchant, unless a special jurisdiction for another place arises by law.
